Did the ADA Ban Personality Assessments? Executive Summary Don’t worry. Despite what you may have heard, the ADA (Americans with Disabilities Act) hasnot banned personality assessments. A recent ruling by the 7th Circuit of the US Court ofAppeals did not stem from pre-employment personality assessment tests. The ruling was theresult of a different type of test entirely – one that was originally designed to measure mentalillnesses. The personality components of Batrus Hollweg’s assessment tests measure job-relatedpreferences and habits. Under current law and federal guidelines, these types of measurementscannot be considered “medical examinations”, and, thus, they are not prohibited as a tool in thepre-employment process.
